Terms

Terms of service for using the Northpoint Design Co. website and for requesting and receiving building design and permit drawing services.

  • Applies to northpointdesign.ca
01

Agreement to these terms

These terms apply to your use of this website and to any quote request or inquiry you submit through it. By using this site or submitting a form, you agree to these terms. They don’t replace a signed service agreement: any paid design or permit work is governed by the written contract for that specific project, which takes priority over anything on this site if the two conflict.

02

Definitions

  • “We”, “us”, “our” means Northpoint Design Co., a sole proprietorship based in Ancaster, Ontario.
  • “You”, “your” means the visitor, inquirer or client using this site or our services.
  • “Site” means this website, northpointdesign.ca.
  • “Services” means the building design, drafting and permit-drawing work described on this site.
  • “Agreement” means the separate written contract or engagement letter covering a specific paid project.
03

Website use

Content on this site (copy, diagrams, glossary entries, and cost or timeline ranges) is provided for general information about our services and is not a quote, permit approval, or professional opinion on a specific property. Every project is different; municipal requirements, fees and timelines vary by location and scope, and figures on this site are estimates only unless confirmed in writing for your specific project.

You agree not to misuse the site: no attempting to gain unauthorized access, interfere with its normal operation, scrape or republish its content at scale, or use it to submit false or fraudulent information.

04

Requesting a quote

Submitting a contact or quote form is a request for us to get in touch. It does not create a contract, reserve any pricing, or commit either side to proceed. Scope, fees and timelines for actual work are set out in a separate written Agreement before any paid work begins.

05

Scope of services

Northpoint Design Co. provides building design, drafting and permit-drawing services under Ontario’s BCIN framework. Structural or mechanical work outside that scope is coordinated with an outside licensed professional and is not represented as in-house work. The specific deliverables, drawings and stages included for your project are set out in the Agreement for that project, not on this site.

06

Fees and payment

Fee ranges shown on this site are for general guidance only. Actual fees, payment schedule (typically a deposit plus milestone or completion payments) and accepted payment methods for a project are confirmed in writing before work begins. Late or missing payment may pause work on a project, as set out in the Agreement.

07

Cancellation and changes

Either side may cancel a project in progress as permitted by the Agreement. Work already completed is billable up to the point of cancellation. Changes to project scope after work has started (for example, a design change or an added unit) may involve additional fees and time, communicated before we proceed.

08

No guarantee of approval

We prepare drawings and applications to meet the applicable building code and municipal requirements as we understand them at the time of submission. Final approval, conditions, review timelines, and any required variances or committee hearings are decided by the municipality and other authorities having jurisdiction, not by us, and can change without notice. We do not guarantee approval, a specific timeline, or a specific outcome.

09

Client responsibilities

You’re responsible for giving us accurate, complete and timely information about your property and project (including existing surveys, drawings, or title and zoning information you hold), for obtaining any consents needed from a co-owner, landlord or lender, and for confirming that any structural or mechanical work coordinated with another licensed professional is engaged and paid separately unless the Agreement says otherwise.

10

Intellectual property

All content on this site (text, diagrams and design) is owned by or licensed to Northpoint Design Co. and may not be copied or reused without permission, beyond normal browsing. Drawings and designs we prepare for a project remain our intellectual property, licensed to you for the purpose of building and permitting that specific project, until the Agreement says otherwise (for example, on full and final payment).

11

Disclaimers

This site and its content are provided “as is” without warranties of any kind, express or implied, including as to accuracy, completeness or fitness for a particular purpose. We update figures on this site periodically, but municipal fees, timelines and program details change. Always confirm project-specific numbers with us directly before relying on them.

12

Limitation of liability

To the fullest extent permitted by law, Northpoint Design Co. is not liable for indirect, incidental or consequential damages arising from your use of this site or reliance on general information on it. Liability for services actually performed under a signed Agreement is governed by that Agreement, not by this website.

13

Indemnity

You agree to indemnify Northpoint Design Co. against claims, losses or costs arising from inaccurate information you provide about your property or project, or from your misuse of this site, except to the extent caused by our own negligence or breach of the Agreement.

15

Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Any dispute arising from this site or, unless the Agreement says otherwise, from our services, is subject to the exclusive jurisdiction of the courts of Ontario.

16

General

  • If any part of these terms is found unenforceable, the rest remains in effect.
  • We may update or discontinue any part of this site at any time without notice.
  • We’re not liable for delay or failure caused by events outside our reasonable control (for example, a municipal service disruption).
  • These terms, together with any signed Agreement, are the entire understanding between us for the matters they cover.
  • You may not assign your rights under these terms without our consent; we may assign ours in connection with a transfer of the business.
17

Changes to these terms

We may update these terms as the business and site develop. The version posted here is the current one. Continuing to use the site after an update means you accept the revised terms.
